Each product placed on the EU market needs to have a product information file (PIF) compiled. The product information file has to be kept by the Responsible person at their address specified on the cosmetic product label, readily accessible in electronic or other format to the competent authorities of the Member state in which the PIF is kept, available in a language which can be easily understood by the local competent authorities, for a period of ten years following the date on which the last batch of the cosmetic product was placed on the EU market. Product information file has to be kept at one single address in the EU and it must always be kept updated and compliant with the regulation 1223/2009. PIF has to contain the following information and data: a description of the cosmetic product, cosmetic product safety report, a description of the method of manufacturing and a statement on good manufacturing practice (GMP) compliance, proof of the effect claimed of the product, any data on animal testing. Cosmetic product safety report is then further divided into 2 parts: part A is the safety information, and part B is the cosmetic product safety assessment, which has to be performed by a properly qualified safety assessor. Safety assessor needs to be knowledgeable in the EU regulation 1223/2009 and needs to have formal proof of qualifications from the fields of pharmacy, toxicology, medicine or a similar discipline, or a course recognized as equivalent by an EU Member State.

Hoverboards were one of the hottest gifts for kids this past Christmas -- until they came under fire – literally. At least 12 reports of hoverboard fires in 10 states are being investigated by the Consumer Product Safety Commission. The investigation includes testing new hoverboards, as well as those involved in accidents, to find out why they caught fire while being charged -- and why some even ignited while being used. These electric-powered skateboards are landing some consumers in the hospital. Emergency Rooms are reporting injuries such as concussions, fractures, contusions and internal organ injuries. The CPSC is asking consumers to inform them of accidents or any sort of safety problem with their hoverboard. The Safety Commission is also urging consumers to treat the hoverboard like a regular skateboard by wearing protective gear, such as: A helmet Elbow pads And knee pads Another advisement from the CPSC is to not charge your hoverboard while you sleep. According to reports received, supposedly a majority of the hoverboard fire incidents occurred overnight while charging. In other news, are crib bumpers really safe for your children? A new study says NO. A report published in the Journal of Pediatrics found that 23 babies died from 2006 to 2012 from suffocation due to a crib bumper. The American Academy of Pediatrics and the American SIDS Institute are advising parents NOT to use crib bumpers because of the dangers they present. According to the Academy of Pediatrics, there is no evidence that crib bumpers protect against injury, instead, they do carry a potential risk of suffocation, strangulation, or entrapment. Only the Consumer Product Safety Commission can implement federal regulations to ban crib bumpers. The CPSC is currently investigating crib bumper deaths due to the recent research. It is difficult to say how much testing is enough: another test can always be run on a product, but at some point the benefit of the extra testing outweighs the costs. In a free-market system, competition among certification firms allows the market to work as it should and prevents both under- and over-testing of products. Conversely, when the government holds the monopoly on safety standards, products are likely to be over-tested, delaying their entry into the market and making them more expensive. I have seen several of these of late and the responses by Product Quality teams are much the same for other item quality complaints. They require you to provide a Plan of Action and redirect you back to your inventory inspection processes, much as they would in an account suspension case. However, we still need more information regarding your plan of action for this Safety Incident complaint before we can reinstate your listing on your behalf." You've got to do some digging and respond with some real understanding of the causes and your solutions to a product safety problem. Otherwise Amazon believes your items pose a risk to buyers. That, and internally Amazon doesn't want to deal with more complaints in the future if they can help it. They cannot scale that work very well. Some odd notifications are being sent to sellers, indicating their listing has been removed due to a "safety incident", though the notification does not give any specifics beyond that. This is making it very difficult to determine how to respond to Amazon, and we're in the process of trying to glean more information about this, but until we figure out exactly what is going on, here is what is important to know: It appears this a Product-Quality driven initiative, and no other teams are currently involved. So far we have seen warnings come through on HPC products and Consumer Electronics, so it doesn't seem limited to one product category. The warnings seem to be triggered by keywords scraped from product reviews. It's not clear if this is a momentary focus, a certain project they are working on, or if this is the new way of things. Amazon's usual MO of warn/warn/suspend/block does not seem to be the way this is working. If you've received one of these notifications, before preparing your appeal you should most definitely: Review all returns and buyer contacts for the last 90 days for potential clues as to the problem. Carefully read all 1 and 2 star product reviews, paying close attention for duplicate complaints. If a safety issue trend is spotted, reach out to the manufacturer immediately with information on these concerns, asking for next steps that should be taken to address the issue. Ask for proof of product safety testing, MSDS sheets, CE, ETL, and audit certifications, etc. When appealing: Provide any documentation that you've received from the manufacturer to support the statement that the product is safe and should be available for sale. Test results, authorizations and certifications are all good ways to prove the efficacy of a product. DO NOT BLAME. (This is just good advice whenever dealing with Amazon.) Provide facts based on your own investigation to show that the product is safe. Do not blame the customer for misuse. Do not deny knowledge of the issue. Do not be anything other than ready, willing and able to get to the bottom of whatever happened. ALBUQUERQUE, N.M.- The hemp-derived CBD industry is currently operating with no oversight from the government, leaving some New Mexico companies to self-regulate. “What this all boils down to is consumer protection,” said Matt Kennicott, a co-founder of Glo CBD which produces chewable CBD tablets. “This is a substance that people are putting into their bodies so we need to make sure it’s clean, it’s safe and what we say is in there is actually in there,” said Kennicott. Some people use hemp-derived CBD for pain or anxiety. However, the FDA is not currently approving any CBD products for commercial sale. Kennicott says his company follows FDA regulations and guidelines for manufacturing that apply mainly to pharmaceutical products. “As you know CBD doesn't really have any regulation around it right now but we wanted to a different company by setting the standard and following FDA regulations,” said Kennicott. 4 Investigates exposed how the CBD industry is currently operating in the dark with no government-imposed health or safety regulations. State Rep. Derrick Lente says a new law will eventually allow the state to hold all CBD companies operating in New Mexico to a common standard. “These types of rules and policies are all being made but they’ll ensure the consumer is buying a quality product from the State of New Mexico,” said Rep. Lente. In the meantime, Kennicott says his company is focused on fostering complete transparency with their product. It features detailed information, including a batch number and a QR code on the label that directs consumers to test results of the product. “What we’re hoping to do is kind of set the standard for CBD companies and when regulations come down, we’re going to be prepared for those regulations and maybe just make a few adjustments here and there,” said Kennicott. While it could take years for the FDA to roll out regulations for CBD products, the State of New Mexico is expected to implement its new rules and regulations in a matter of months.
