Australian Consumer Law -- Chapter 10 -- Product safety
Under the ACL, Australia has a national product safety regime. Australian Governments are able to issue safety warning notices, impose mandatory safety standards, impose compulsory recall notices and ban products either temporarily or permanently. The Most Dangerous Monopoly: When Caution Kills
"The Most Dangerous Monopoly: When Caution Kills" by @LearnLiberty ► Get Learn Liberty updates in your inbox! http://LearnLiberty.org/subscribe Everyone wants the items they buy to be safe to use or consume. Howard Baetjer of Towson University explains that when products undergo third-party certification processes to determine their safety, market forces are able to optimize the amount of testing conducted and consumers can use the information provided by certification firms to make their own decisions. It is difficult to say how much testing is enough: another test can always be run on a product, but at some point the benefit of the extra testing outweighs the costs. In a free-market system, competition among certification firms allows the market to work as it should and prevents both under- and over-testing of products. Conversely, when the government holds the monopoly on safety standards, products are likely to be over-tested, delaying their entry into the market and making them more expensive. Sometimes the costs of such delays cannot be quantified; lives can be lost while life-saving medicines are held up in safety-testing processes. [Industry professional news channel itsTV] Contribution on increasing the product safety
[Anchor] The increasing concern of product safety has helped some companies increase their sales. It is the result of meeting the customers' tastes and needs. More specifically, those who pursue safer products. With the enactment of the Basic Laws on Product Safety, more and more companies are expected to join in on this trend. We have the details. [Reporter] Livart, the interior shop of a famous domestic furniture company, only sells furniture certified for using eco-friendly materials. Also, by producing round-edged furniture for students and a hinge for children, this company satisfies both safety and design. With consideration for safety and the environment in mind throughout the entire process from design to production, the company has seen a huge growth in sales by forty one percent during the last six years. Getting recognized for their contribution on developing eco-friendly safety devices, Livart was awarded the "Bronze Tower Industrial Award". [Interview - Gyu-han Kyeong, the CEO of Livart] ~ Especially, in terms of life and culture, not only our company but our outsourcing companies and construction companies that work with us, should cooperate and study on the quality of the safety... The Korea Agency for Technology and Standards, or KATS, held the "Product Safety Day 2011" event and presented awards to forty four men and companies of national merit this past September second at the COEX in Seoul. [The Effects of Sound - Sang-jick Yoon, Vice Minister for Industry and Technology of MKE] ~ Not only quality but safety is becoming a crucial factor to expand exports. In other words, at this point, long-maintaining innovation for promoting product safety is required more than ever. With the implementation of the Basic Laws on Product Safety this year, consumers' expectations on the safety of products has been increasing. The Government said that to jump up to the level of advanced countries, it should work together with companies and consumers to understand the necessity of product safety while at the same time, perform their own duties. Product Safety: Are Hoverboards Safe?
Hoverboards were one of the hottest gifts for kids this past Christmas -- until they came under fire – literally. At least 12 reports of hoverboard fires in 10 states are being investigated by the Consumer Product Safety Commission. The investigation includes testing new hoverboards, as well as those involved in accidents, to find out why they caught fire while being charged -- and why some even ignited while being used. These electric-powered skateboards are landing some consumers in the hospital. Emergency Rooms are reporting injuries such as concussions, fractures, contusions and internal organ injuries. The CPSC is asking consumers to inform them of accidents or any sort of safety problem with their hoverboard. The Safety Commission is also urging consumers to treat the hoverboard like a regular skateboard by wearing protective gear, such as: A helmet Elbow pads And knee pads Another advisement from the CPSC is to not charge your hoverboard while you sleep. According to reports received, supposedly a majority of the hoverboard fire incidents occurred overnight while charging. In other news, are crib bumpers really safe for your children? A new study says NO. A report published in the Journal of Pediatrics found that 23 babies died from 2006 to 2012 from suffocation due to a crib bumper. The American Academy of Pediatrics and the American SIDS Institute are advising parents NOT to use crib bumpers because of the dangers they present. According to the Academy of Pediatrics, there is no evidence that crib bumpers protect against injury, instead, they do carry a potential risk of suffocation, strangulation, or entrapment. Only the Consumer Product Safety Commission can implement federal regulations to ban crib bumpers. The CPSC is currently investigating crib bumper deaths due to the recent research. Why Integration Between Your Quality Management System and Product Safety System is Important
Although the responsibility of investigating product complaints generally falls within the Manufacturing or Product Quality business unit, life science companies are required by law to report any product complaints to regulatory authorities if there is an associated adverse event or serious adverse event. The absence of a detailed adverse event evaluation in product complaints often causes serious audit findings, warning letters or even millions of dollars in fines from regulatory agencies. A large part of the problem is that in most pharmaceutical companies, the safety system and the quality management system are not integrated – both the technology and the processes are completely separate. This lack of integration introduces a tremendous amount of regulatory and financial risk to the company. Join our subject matter experts Anjani Jha, Senior Director of November Research Group and Dave Hess, Solutions Consulting at Sparta Systems as they discuss how pharmaceutical companies can leverage and integrate advanced quality management and pharmacovigilance solutions to deliver immediate value into a company’s business process. Topics will include: • Challenges that life science companies face when running separate safety and quality management systems • What an integrated system looks like • Benefits of integration with tangible results

Cosmetics product information file (PIF)
http://www.ceway.eu This clip presents what is a cosmetics product information file (PIF) and which information it consists of. Each product placed on the EU market needs to have a product information file (PIF) compiled. The product information file has to be kept by the Responsible person at their address specified on the cosmetic product label, readily accessible in electronic or other format to the competent authorities of the Member state in which the PIF is kept, available in a language which can be easily understood by the local competent authorities, for a period of ten years following the date on which the last batch of the cosmetic product was placed on the EU market. Product information file has to be kept at one single address in the EU and it must always be kept updated and compliant with the regulation 1223/2009. PIF has to contain the following information and data: a description of the cosmetic product, cosmetic product safety report, a description of the method of manufacturing and a statement on good manufacturing practice (GMP) compliance, proof of the effect claimed of the product, any data on animal testing. Cosmetic product safety report is then further divided into 2 parts: part A is the safety information, and part B is the cosmetic product safety assessment, which has to be performed by a properly qualified safety assessor. Safety assessor needs to be knowledgeable in the EU regulation 1223/2009 and needs to have formal proof of qualifications from the fields of pharmacy, toxicology, medicine or a similar discipline, or a course recognized as equivalent by an EU Member State.

Steps to the EU market for cosmetic products
http://www.ceway.eu This clip presents the steps which cosmetic product manufacturers need to take in order to be able to sell their products in the EU. The rough steps for placing the cosmetic products on the market are the following: classify your product, assign a responsible person, compile the product information file, notify your product to the CPNP, put your cosmetic product on the EU market. You have to remember that you should also always keep the product information file updated. For the classification of your products you should check the definition of cosmetic products in the EU, which can be found in the EU cosmetics regulation 1223/2009. The second step is to assign a responsible person. This is requested the EU cosmetics regulation by saying: "Only cosmetic products for which a legal or natural person is designated within the Community as "responsible person" shall be placed on the market." Responsible person has to be designated by a written mandate and has to accept this role in writing. Product information file (PIF) is a basis for pre-market notification of cosmetic products. The product information file contains various information about the cosmetic product, including raw material specifications, finished products specifications, packaging specifications, cosmetic product safety report (CPSR), labelling etc. The last step before you can place the cosmetic product on the market is the notification of your product to the CPNP portal. Product notification has to be performed by the responsible person. The links which are mentioned in the clip are the following: - cosmetic product definition: http://www.ceway.eu/is-your-product-even-a-cosmetic-product/ - responsible person: http://www.ceway.eu/european-responsible-person-rp/ - product information file: http://www.ceway.eu/product-information-file-pif/ - cosmetic notification: http://www.ceway.eu/notification-process/
