How Should I List Products and Services in My Trademark Application? Secure Your Brand with Trademark Factory® Risk-Free, Guaranteed. https://www.trademarkfactory.com A trademark does not give you a monopoly over the name, logo or tagline in vacuum. Trademark does not make you the owner of that name. What you end up owning is the combination, the mental link between the brand and the particular products and services that you offer. So whenever you file your trademark application, not only do you have to tell the Trademarks Office what the trademark actually is, you should also tell them what products and services you offer under that brand and that you want to make sure that nobody else in that jurisdiction has a legal right to use that brand in association with those or similar products and services. So, there are a few strategies that you should be aware of when you file your trademark application. First of all—you need to put you visionary cap on—you need to be very clear what products and services you are using today and that you may end up offering at some point in time in the future, foreseeable future. Think about 2–3 years from now: what else can you start offering under that same brand. And the reason that I’m saying 2 or 3 years is because in both Canada and the U.S. after your trademark gets allowed, it won’t get registered until you tell them (or show them in the U.S.) that you already commenced using the trademark in connection with all the products and services listed in your trademark application. So if you know that you are not going to do something, don’t add that to your trademark because it still won’t register for that particular product or service. And you only have so much time from the filing date to the registration date to actually show the use of that brand for a particular product and service. But again, if you think, “You know what? I might or I might not have a book with this name, I might or I might not have a podcast, I might or I might not sell t-shirts…” I don’t know. But, you need to be very clear, what are you probably going to end up using this trademark in association with. And here is the second thing to consider. A lot of business owners say, “We might have some promotional things, should we get a trademark for those?” Usually the answer is no. Promotional things are not what your business is about. Every single businessman or businesswoman has a business card. We all have business cards. And the business cards have the information about who we are, what we do, how we can help people to do what we do for them. But nobody in their right mind trademarks their brand in association with business cards unless we offer printing services and we make business cards for others. So here is another thing. Very importantly, the trademark application is not your marketing booklet. You don’t have to prove to the Trademarks Office how great your products and services are. They don’t care. They don’t care how good they are, they don’t care how they’re different from everybody else who does the same thing, all they care about is the list. So if you have an accounting business, you don’t need to tell them, “Well, we do accounting services and we have high quality and we’re very personable”. They don’t care. All they care about: “Accounting services”. That’s it, thank you. Don’t use your trademark application as your marketing piece. We see these all the time, and the Trademarks Office does not like them. They always want you to rewrite them and sometimes you just reveal too much and you run the risk of them having to find that your mark is descriptive. Now, the other thing. Remember what I said you only want to only put products and services in the list that you are currently using or that you think you might be using in 2-3 years, right? Having said that, the way you put the things in the list, you want to be as broad as possible. So, if you can get protection for the entire industry, don’t narrow it down too much. Because that will allow you to use that brand, and stop everyone else from using similar brands in overlapping industries. There is always this battle between the trademark owner and the Trademarks Office because the Trademarks Office wants the list to be very specific. We have and continue to handle many trademark infringement cases. To determine if it is a trademark infringement, the courts look at the following factors: 1. the strength of the mark; 2. the degree of similarity between the two marks; 3. the proximity of the products; 4. the likelihood that the prior owner will bridge the gap; 5. actual confusion; 6. defendant's good faith in adopting its own mark; 7. the quality of defendant's product; and, 8. the sophistication of the buyers. This is not intended to be an exhaustive list, but is merely a starting point. Furthermore, when evaluating the similarity of the marks, the sound, meaning and commercial impression of the marks are evaluated (see factor #2). The ultimate test is whether or not consumers are going to be confused. There are also additional provisions in the law to remedy § 43(a) Unfair Competition (15 U.S.C. § 1125(a)) - Under the Lanham act, unregistered marks are protected as well. And trade dress, etc. This provision has far reaching implications and has provided protection for restaurant formats, colors of products, sounds and smells. The key difference in proving an infringement of a registered trademark and an unregistered mark is that in the case of an unregistered mark it is necessary to demonstrate that the mark functions as a mark, namely that it has acquired secondary meaning and it indicates source There is also protection for famous marks and to prevent dilution of those marks. Under the trademark statute there is also the Anticybersquatting Consumer Protection Act also known as the ACPA which permits trademark owners to stop the unlawful misappropriation of domain names by third parties.

How Do I Trademark Product Names? But product names were the original reason for trademarking. You had a product, a physical product, and you had a brand name attached to it that you wanted to protect… So how do you approach trademarking product names? Ideally, you don’t want to have the type of your product trademarked as part of the name. Apple did not trademark “iPad Tablets”, they trademarked “iPad”. McDonald’s did not trademark “Big Mac Burgers”, they just trademarked “Big Mac”. So if you can possibly trademark your name without the description after it—that’s a stronger trademark, that would give you a lot more ways to go against somebody else who may want to use your name for something close, but not quite. That’s especially important for the food industry where there is a lot of different possibilities, but the brand can be recognizable for the entire thing. So if you can get away with not adding the specific things that you’re selling under your brand, don’t add those things to your trademark application. Registered trademarks have the advantage that you can protect your company name, product name or logo so that competitors cannot use the same or a highly similar name or logo for the same or very similar goods or services. An example: a dance studio called Mojo can protect its name with a registered trademark for the services of a dance studio. This way, competitors will not be able to legally name their own dance studio Mojo. However, you may have to watch out for earlier identical or similar trademarks to avoid conflicts. I have posted a video about trademark search and the link is in the shownotes. So what do you need to register a trademark? In many countries or regions such as the EU you can file trademark applications electronically on the website of the respective office like the USPTO, the OHIM, the German Patent and Trademark Office or WIPO. All you really need is - The name you want to protect – or the logo in JPG format - The exact details of the applicant and later owner - The list of goods and services grouped by the so called Nice classes - Money So what are the Nice classes? All goods and services are grouped into 45 Nice classes. As an example there is class 43 for restaurants, class 16 for books, class 9 for software, or class 41 for dance studios. It is advisable that you consult a patent attorney or other trademark lawyer, but I posted a link to the definition of the Nice classes in the shownotes. Do we need to register our trademark in China before entering the Chinese market? What if we only do our manufacturing in China and export our products to other markets? Well for companies that do not actually have an operation entity in China but they have an OEM manufacturer in China; we would still strongly recommend to register trademark. If you have a manufacturer, that means your brand and your trademark and your products have been exposed to quite large amount of public, although the manufacturer are binding to the confidentiality agreement or your contract, there is still a risk that this person or the other entity can take advantage of your trademark and we actually have been seeing cases like this. And later on, it gets very bad with the litigation and arbitration so filing will be at a very defensive aspect of protecting your trademark even though you are now selling in China. So that's from the manufacturer side, and from the other side, which is about exporting your goods manufactured in China and exporting to your destination country, and the custom registration actually require to record your trademark, to make sure they are genuine products, so if the trademark registration does not come from you, come from another entity and their registration took advantage of that, it actually can stop your actual export, which will create quite amount of damage, to your factory and to your whole business. So filing is very important to China. And a very important sign though is China is the first to file country, which means timing is very important. What information and documents are required to file a trademark application in China? If you wish to file and then using an agent, first we will probably ask you to sign a power of attorney, authorizing us to submit the application, and then we will provide you with a list of documentation that we need from you, and also if you have filed your application in Canada, we may also need the files from the Canadian trademark office as well. Well generally, the trade office will need the full name of the applicant, and the nationality and the address of it. We also need photocopy of the certificate of the good-standing of the applicant, as well as would need all the trademarks that you wish to register. And the specimen, with specimen we also have some requirements, how high the resolution needs to be, how big it needs to be, so it needs to follow a certain guidelines, and after that we will be looking at the goods, which class that you are interested in register in, and which subclass, you will be interested in registering. If I have a TM registration filed in Canada, can the registration or application be useful in China? You can have a six months’ time window, to file that same application in China, at the same time you will be enjoying the benefits of your first filing date. And after you have filed the application, you will have another three months’ time window, to provide us with all the documentation you have given to the Canadian authority, and I will be asking you to give the Canadian authority's contact because we will need the official papers to prove that these are genuine copies. 5 Things You Should Never Say About Your Brand Secure Your Brand with Trademark Factory® Risk-Free, Guaranteed. https://www.trademarkfactory.com Here's my list of five things you never want to say about your brand, in no particular order. Number one, you don't want to say this, "You see, we took the name of our competitor, changed a couple of letters here and there. Kind of clever, right?" Here's why you don't want to say that. In the best case scenario, you're going to end up with a brand that's too close to somebody else's so the value of the brand which you're building will be very low. In the worst case scenario, you're going to find yourself in the middle of a very expensive and unnecessary litigation. So don't be clever trying to take a free ride on your competitor's trademarks. Come up with your own. Here's number two. What you don't want to say is, "Search engine optimization is very important to us. We need to be on page one of Google for the kind of services and products that we sell, so we picked one of these generic keywords as the name of our business." There's a huge difference between SEO, search engine optimization, and brands and trademarks. You cannot trademark something that's generic. You can't trademark something that's merely descriptive, that simply tells the world about the features or benefits of your products and services, because trademarks are not designed to give you the monopoly over your products and services. Trademarks are designed to give you the monopoly over the name or the logo or the taglines, so something that allows people to identify your products and services apart from everybody else's identical or similar products and services. If you are an Indian restaurant in Vancouver, as much as you'd like to be on page one of Google with Vancouver Indian Restaurant, don't call your restaurant Vancouver Indian Restaurant because that's the name you will never be able to own. Thing number three you don't ever want to say, "I'm glad I didn't waste money on trademarking. My business went bust, anyway." Well, this is kind of self-explanatory. Very few businesses have any value left in their brand after their business dies. The rare exceptions are the likes of Polaroid and Kodak where IR release is the only thing left after the business went bust. Nobody starts their business hoping to fail, and I hope it never happens to you, but making your decision about whether or not it's a good idea to trademark your brand based on the risk that your business may go bust is insane. Because, yeah, of course, there's always a risk that something might not work out and that your business will go bust, you still have to protect your brand. Here's my number four, and a lot of litigation lawyers hear that. It goes something like this: "I came up with the idea for that name first, but." With trademarks, it doesn't matter who came up with the idea first. What matters is who put that name out to the market first? Who builds that website where people could see the brand? Who started selling products under that brand? Who started advertising services under that brand? Doesn't matter that you were the first to register that domain name. Until there's a way for the public to consume your products and services under that brand, you don't own that brand. Outside of North America, it's not even about who started using it first. It's who first went to the trademark's office and applied to register their trademark because they don't recognize first. Usually, they recognize only registered trademarks. Last, but not least, and that's the one that pisses me off more than anything else, that's the phrase you never want to leave your mouth. It goes like this: "And who's going to deal my brand?" Look, if you're building a business and you think that your brand is not worth stealing, it means one of the three things: Either you have the wrong brand, you have the wrong business, or probably both. If you think your brand is good enough, go and trademark it. If you don't think your brand is good enough, pick a different brand. Find something that you will feel strongly about. I typically recommend to people I speak with and coach about eBay sales to not list brand name stuff. Specifically to not list high end brand name stuff. These items have a tendency to be taken down and removed from eBay, even if it's authentic legitimate stuff your selling. Sometimes it's a glitch that removes it, sometimes it's buyers who don't know the difference between real and fake, andother times it's competing sellers trying to mess with you. eBay also has something called the VERO program which allows brands to have eBay listings removed if they feel the item is fake. Some brands really abuse this and eBay isn't too quick to listen to sellers or give them the chance to prove this to not be the case. Recently I was contacted by someone who sold a high end bag with the actual receipt next to the item proving they bought it and they still had the listing taken down. For this reason I typically encourage people to avoid sellign brands in general and specifically to avoid selling high end brand name products just to avoid any problems or issues,
